Circular of Shanghai Municipal Commission of Housing and Urban-Rural Development

on Further Optimizing Quality and Safety Management of Small-scale Construction Projects in Shanghai

 

All relevant agencies:

In order to fulfill the requirements of municipal government documents Circular on Printing and Issuance of Pilot Implementation Plan of Review and Approval Reform of Construction Projects in Shanghai (H.F.G. [2018] No.14), Circular on Printing and Issuance of Further Deepening Implementation Measurement of Review and Approval Reform of Private Investment Projects in Shanghai (H.F.B.F. [2018] No.4), to further deepen the reforms of streamlining administration, delegating powers, and improving regulation and services, to optimize business environment of dealing with construction permits, to have all construction participating parties to undertake their responsibilities, to strengthen the quality and safety management of small-scale construction projects,relevant matters are notified as follows:

I. The small-scale construction projects referred in this circular are new buildings, alternations and extensions. The gross construction area of one project is no more than 10,000 square meters, the height is no more than 24 meters, with simple functionality and technical requirements. However, children indoor playgrounds, elder care facilities, and factories and warehouses for production and storage of flammable and explosive dangerous substances are excluded.

II. All levels of construction authorities and the authorized construction projects quality and safety supervising agencies shall conduct inspections and implement differentiated supervision based on the features, scales, technical complexities of the construction projects and credit status of constructionparticipating parties. The focus of the inspections shall be structural safety, parts and items of a construction that have higher level of dangerousness, behaviors of construction participating parties including their implementation of technical inspections of quality and safety risks and how they fulfill the commitments to carry out the quality and safety management when the construction starts, etc. Detailed requirements are as follows:

(I) Cancel the first quality and safety supervision meeting of small-scale construction projects.During the stage of construction permitting, construction authorities adopt measure of online notification to notify the owner companies of quality and safety supervision matters and requirements.

 (II)Conduct one-time inspection of projects below during the construction:

  1. A factory or warehouse with gross construction area no more than 5000 square meters.

  2. Public buildings (shopping malls, office buildings, hotels and buildings for cultural, sports and tourism purposes) with structural height not exceeding 12 meters and without basement.

       (III)  Conduct two times of inspections of projects below during the construction:

  1. A factory or warehouse with gross construction area more than 5000 square meters.

  2. Public buildings (shopping malls, office buildings, hotels and buildings for cultural, sports and tourism purposes) with structural height exceeding 12 meters or basement.

(IV) Conduct at least two times of inspections of projects below during the construction:

  1. Residential buildings;

  2. Public buildings for educational and medical purposes.;

  3. Projects that contain more dangerous parts and items beyond a certain scale;

  4. Projects that owner companies will not have the ownerships by themselves after the projects are in usage.

       III.During the construction, an owner company shall coordinate among supervision company, construction company to organize technical inspections of quality and safety risks at stages of pile foundation, foundation, primary structure, decoration, curtain walls, energy conservation (hereinafter referred to as technical inspections).

IV. The owner company shall take the primary responsibility for technical inspections; construction company and supervision company each takes responsibility of the enterprise itself based on the works it undertakes.

V. Technical inspections shall be carried out based on the quality and safety risks at different stages of the construction. Quality risks shall be determined according to critical parts and construction procedures. Safety risks shall be determined according to scope of more dangerous construction parts and items. Technical inspections may be carried out when construction company performs inspections of construction procedures by itself and supervision company takes supervising activities on site. Quality and safety risk levels of small-scale construction projects at different stages are divided into level 1 and level 2 (Kindly please refer to the attachment for List of Quality and Safety Risks and Risk Levels at Each Construction Stage.)

VI. The procedures of technical inspections include risk identification, implementation of inspection and conclusion of inspection. Specific requirements are as follows:

(I)Risk identification

Risk identification shall be completed before construction commencement. The technical head of the construction company shall identify and determine the quality and safety risks and relevant levels for each construction stage according to list of quality and safety risks and relevant risk levels at different construction stages, which shall be confirmed by chief supervising engineer and project head of the owner company.

(II)Implementation of inspection

According to the identified list and levels of quality and safety risks, the owner company shall organize construction company and supervision company to carry out technical inspection. Level 1 quality and safety risks at every construction stage shall be inspected by the team which consists of project head of the owner company who shall be responsible to organize the inspection, professional technicians of construction company and professional supervising engineers; Level 2 quality and safety risks shall be inspected by the team which consists of project head of the owner company who shall be responsible to organize the inspection, technical head or authorized professional technicians of construction company and chief supervising engineer.

(III)Conclusion of inspection

When technical inspection of each stage is complete, the owner company shall form technical inspection report together with construction company and supervision company. The technical inspection report shall reflect how were the inspections and the correction of problems. At the stage of final inspection of built construction, the owner company, companies of geotechnical investigation, design, construction and supervision shall form a final inspection team to verify the technical inspection report.

VII. If construction participating parties are found not to carry out technical inspection, not to fulfill the commitment, quality or safety accident occurs in the construction project, or other acts and situations are found against laws and regulations, construction authorities or supervising agencies shall increase times of inspections and enhance the level of investigation and punishment by taking rectification order, cancellation of measure of commitment or revocation of relevant permits. If the circumstances are serious, administrative punishment shall be imposed according to law and related party(parties) shall be blacklisted.
