Notice of Shanghai Municipal Bureau of Ecology and Environment on the Categories of Construction Projects Not Included in the EIA Management System

To relevant units:

In order to improve the business environment and promote the reform of EIA approval system, our bureau has studied and formulated the Categories of Construction Projects Not Included in the EIA Management System (2019 Edition) based on the actual situation of the city. The Notice is now printed and issued to you. Please earnestly implement it.

I. Projects listed in the Notice do not need to go through relevant procedures of construction projects EIA. However, the construction units shall not be exempted from environmental protection responsibilities.

II. The construction units shall obey laws, regulations, standards and related technical specifications of the state and the city on environmental protection, regulate the discharges of pollutants, and accept daily supervision and management of ecological environment management departments at all levels.

III. The Notice has been in effect since February 22, 2019 and is valid until February 21, 2024. The Notice of the Shanghai Environmental Protection Bureau on the Categories of Projects Not Included in the Construction Projects EIA Classification Management in Shanghai (2015 Edition) (Shanghai Environmental Protection Review No. 524) shall be annulled from the date of implementation of the Notice.

and sewage pipes include: health preservation services, foot therapy(not including foot therapy medicine that does not contain laboratory tested pharmaceuticals and Chinese herb medicine; housekeeping services, laundry shops, hair salons, matrimonial agencies, home appliance and electronics maintenance shops, tailor shops, optical shops, beauty and message salons, pet stores, and animal clinics and hospitals that are not qualified to carry out animal cranial cavity, thorax, and abdominal cavity operations; property management; express service spot; hotels of various sizes that only provide accommodation; waste recycling stations(not including recycling stations that process and dispose garbage); trade agencies; gold and silver jewelry process stores that operate in shops, stationary stores, and shop signs store that don’t have the business of material surface treatment; and public bathhouse and saunas.

Large-scale shows and film shootings should not be held in environmental sensitive areas.

Notes:

a. For construction projects owned by families, once becoming manufacturing enterprises of scale, they should go through environmental protection procedures according to classification management directory.

b. Environmentally sensitive areas refer to all the areas included in the 1st and 2nd clauses of Article 3 of The Classification Management Directory of Environmental Impact Assessment of Construction Projects.

c. Processes involving assembly and testing only should not involve drilling, cutting, bending, welding with solder, gluing/bonding, cleaning of pharmaceuticals (solvents), generation of exhaust or waste water, etc.

d. Environmentally sensitive areas refer to all the areas mentioned in 1st clause of Article 3 of The Classification Management Directory of Environmental Impact Assessment of Construction Projects; 2nd clause of Article 3, including basic farmland protection areas, basic grasslands, forest parks, geological parks, important wetlands, natural forests, important habitats for wild animals, and growing land of key protected wild plants.

e. Environmentally sensitive areas refer to all the areas mentioned in 1st clause of Article 3 of The Classification Management Directory of Environmental Impact Assessment of Construction Projects; 2nd clause of Article 3, including basic farmland protection areas, basic grasslands, forest parks, geological parks, important wetlands, natural forests, important habitats for wild animals, and growing land of key protected wild plants; culture relic protection units mentioned in 3rd clause of Article 3.
