Circular on Implementing the Deduction of and the Exemption from Related Fees and the Cancellation of the Review of Construction Drawings and Design Documents for Small-scale Industrial Projects with Private Investment in Shanghai

To all District People’s Governments, Commissions, Offices and Bureaus of the Municipal Government，administrative commissions of special area, all related units:

      In order to deeply study and implement the General Secretary Xi Jinping's important instruction regarding “Shanghai should target the highest standards and levels and create a world-class business environment, to carry out to the letter the implementation of the requirements of the municipal government on “deducted procedures, reduced time, less material, lowered cost”, with the approval of the municipal government, we decided to related fees and cancel the review of construction drawings and design documents for small-scale industrial projects with private investment in Shanghai. The related matters are now notified as follows:

I. Implementation Scope of the Deduction and the Exemption

Small-scale industrial projects with private investment the in Shanghai municipality (referred to new standardized factories and common warehouses, alteration and addition works for existing standardized factories and common warehouses, and industrial projects that realizing industrial spatial layout according to the three-layer system “industrial bases – industrial communities – scattered industrial plots”, and one project should meet the following requirements: gross floor area is less than 10000 square meters, the height isn’t over 24 meters, simple function and technical requirement).

II. Implementation Contents of the Deduction and the Exemption

With the premise that the authorization of existing laws and regulations remains unchanged, according to the statutory duties, for small-scale industrial projects, the related fees of geotechnical investigation, construction supervision and construction drawing review shall be covered through the method of government procurement of services and related works shall be commissioned respectively to geotechnical investigation companies, supervising companies and review agencies who meet certain qualification requirements to carry out. Qualification requirements shall be formulated separately by the construction administration department. For new small-scale industrial projects, geotechnical investigation should be completed before land transfer.

III. Safeguarding the Expenses

Relevant departments of the district governments shall comply with the relevant institutional provisions, cost control requirements etc., sign agreements with geotechnical investigation companies, supervising companies and review agencies and make the related payment. The required expenses are included in the annual budgets of the relevant departments of the district governments.

IV. Legal Responsibilities

The above exemption from the related fees won’t change the legal responsibilities of the owner companies, geotechnical investigation companies, supervising companies and construction drawing review agencies for project quality and safety management.

V. Cancellation of construction drawing and design documents review for any private investment industrial project with gross floor area less than 3000 square meters

For this category of projects, owner companies aren’t required to commission construction drawing review agencies to conduct construction drawing review, which is no longer the premise of construction project planning permit and construction permit. Engineering design companies shall bear the related legal responsibilities for the construction drawings and design documents that they’re responsible for formulation.Construction administration department should conduct online random check on the quality of the design drawings strengthening the interim and ex-post supervision of design quality and engineering safety.

VI. Supplementary Article

The people's government of each district shall research and formulate specific operational measures, publish them on the portal websites and accept social supervision. Municipal construction administration department and financial department should strengthen guidance to each district on relevant works.

VII. Effective Date

This Circular shall be effective since the date of issuance.
