Detailed Regulations on Implementation of Improving the Review and Approval Service Quality of Low-risk Social Investment Project
Article 1 In order to continuously optimize and improve the construction permit business environment of this city, and further improve the review and approval efficiency and service quality of low-risk social investment projects, according to the Opinions of the General Office of the State Council on Implementation of the Comprehensive Reform of the Review and Approval System for Construction Projects (GFB No. 11 [2019]) and the municipal government office’s Implementations Measures of Further Deepening the Review and Approval Reform of Social Investment Project of This City (HHBF No. [2018] 4) and other documents, combined with the actual situation of the city's construction projects, these Regulations are hereby formulated.
Article 2 These Regulations are applicable to all newly built, renovated and expanded low-risk social investment project invested or dominantly invested by private enterprise, foreign investor and Hongkong, Macao and Taiwan enterprises.
Low -risk social investment project refers to the standard plant, common warehouse with single function, simple technical requirement, gross floor area no more than 3,000 square meters, building height no more than 24m, invested or dominantly invested by private enterprise, foreign investor and Hongkong, Macao and Taiwan enterprises and the small industrial project based on “industrial base – industrial community – sporadic industrial plot” three levels of industrial spatial layout and implementing the system of “being transferred with scheme”.
Except for the safety protection projects involving flammable and combustible, toxic and harmful substances, projects with great ecological impacts, and specific areas such as landscape protection and rail transit protection.
Article 3 Fully implement “one network handling platform”. All procedures of low-risk social investment projects are handled online through the “Shanghai Construction Project Approval Management System” (hereinafter referred to as “Approval Management System”) in the “China Shanghai” online government service hall. The whole process is completed online, based on electronic license review and digital archives data.
Article 4 Fully implement “one-stop” service and “one form” application. Establish a municipal and district social investment project review and approval center (hereinafter referred to as the “review and approval center”), realize the one-stop service mode of “integrated online acceptance, approval by category, unified certification issuance”, and coordinate the procedure of low-risk social investment projects.
Article 5 Provide one-stop application and obtain building permit. Developer is not required to conduct design scheme review, and could directly fill in online application form for building permit, simultaneously upload application data and construction drawing design documents via approval management system, and submit one-stop application for building permits (including application for planning permit and construction permit) to district review and approval center where the project is located.
After application is received, it will be synchronically sent to same level planning and natural resource department and construction management department for online review within limited period. After obtaining approval, Developer could obtain planning permit and construction permit in one time, and get relevant requirements on engineering quality and safety supervision at the same time via approval management system.
Article 6 Adjust construction drawing review mode. Developer shall no longer entrust drawing review organization for construction drawing review. Construction drawing review is no longer a precondition for obtaining planning permit and construction permit.
After accepting application for building permit, review and approval center will send construction drawing design documents synchronically to district construction management department or specific district management committee where this project is located. District construction management department or specific district management committee shall entrust drawing review organization to conduct online spot check of design drawing quality, and enhance design quality supervision in the course and afterwards.
If surveying design quality is founded in spot check, drawing review organization shall send spot check comments to Developer and quality and safety supervisor. Developer shall revise construction drawing design documents as per spot check comments, while quality and safety supervisor shall incorporate the implementation situation of spot check comments into supervision scope during construction.
Article 7 Optimize quality and safety management and control. As per different risk categories, set up different frequency inspection requirements, establish risk based differential supervision system, and adopt mixed supervision pattern combining regular and irregular supervision. For low risk social investment project, quality and safety supervisor shall conduct one regular supervision and inspection from project construction till top-out of main structure, and before decoration construction, and focus on checking construction contractor’s execution of quality, safety risk and technical inspection, performance of commitments for taking site quality and safety measures, and revision of construction drawing design documents as per spot check comments. Check result will be incorporated into credit information management archives of construction contractors and relevant personnel.
Article 8 Provide one-stop application and complete six-party acceptance. After the projects possesses the acceptance conditions, Developer could fill in application form online at completion acceptance stage via approval management system, synchronically upload application data and completion drawings, and send one-stop application for six-party acceptance (including planning and natural resource department, construction management department, developer, construction contractor, supervisor and design firm) to district review and approval center where the project is located.
For project being approved, approval management system will immediately issue Notice of Comprehensive Completion Acceptance uniformly issued by construction management department (attached with land acceptance comments of planning and natural resources department). Developer could download the notice online.
Delete procedures for acceptance of and recording in fire department, and completion acceptance of and recording in construction management department. Change supervision method of traffic police, traffic and greening and cityscape management as well as sanitation & health departments to afterward supervision. Prior inspection on site is no longer required. It no longer requires execution of specialty acceptance procedure and issuing of specialty acceptance comments.
Developer could handle procedures for real estate registration with Notice of Comprehensive Completion Acceptance, and other materials.
Article 9 Upgrade plumbing access services. For projects involving water supply and drainage access service, after Developer applies for construction permit by one-stop services, application information of plumbing access is sent to plumbing department automatically by review& approval management system. Plumbing department will provide free whole-process service and it is unnecessary for Developer to handle any administrative permit process.
For projects involving external engineering, after confirming information, plumbing department will complete site survey and review within 4 business days, and sends related information to planning, traffic road administration, greening, traffic police and other related departments, completes related review& approval items within 5 business days and completes plumbing access within 5 business days.
Article 10 Simplify review& approval items. Cancel independent online recording step of low-risk social investment projects. When applying for construction permit, Developer can automatically complete information recording via review& approval management system.
Low-risk social investment projects are exempt from procedure of environmental impact assessment.
Article 11 Reduce period of review and approval. Procedure at construction permit stage shall not last for more than 7 business days (no more than 5 business days for planning permit and no more than 2 business days for construction permit). Planning permit and construction permit shall be issued online.
Procedure of six-party acceptance stage shall not exceed 5 business days and comprehensive acceptance notice shall be issued online.
Procedure of real estate registration shall not exceed 5 natural days, and real estate registration department shall mail the certificate of title.
Article 12 Ensure “zero cost” for construction review and approval of projects. It is unnecessary for Developer to go through geological survey and entrustment of project supervision institute, government will entrust qualified institutes by government’s purchase of services. Geological survey shall be completed within 10 natural days by related departments of the district-level people’s government and management committee of special area.
Civil air defense work will not be provided for supporting facilities of industrial land project approved by planning and natural resource department and relocation construction fee will not be required.
Article 13 Strengthen the major responsibility of the registered practitioners and improve professional qualification and education requirement of drawing reviewer, registered supervision engineers and registered architects. Besides satisfying national registration requirements and the minimum years of employment, they shall have bachelor degree or above in engineering major.
Besides satisfying the minimum years of employment stipulated in Management method for quality safety supervisory organization and personnel appraisal of construction projects in Shanghai and obtaining administrative law enforcement certificate published by municipal or district government, site quality supervision and management personnel shall have bachelor degree or above in engineering major.
Article 14 Support the third-party consulting service agency to provide market-oriented professional consulting services. Further strengthen the main responsibility of Developer, encourage qualified Developer to carry out pilot of architect-responsibility system or entrust quality project management institute to conduct the whole-process engineering consulting services to improve professional level of project management.
Article 15 This rule will go into effect as of the date of issuance.
