Circular of the Shanghai Municipal Commission of Housing and Urban-rural Development on Starting the Use of Letter of Compliance for Integrated Final Inspection and Completion of Construction Project in Shanghai

To all related units:

In pursuant to Notice of the General Office of the State Council on Launching the Pilot Program of the Reform of the System for Construction Project Approval (G.B.F. [2018] N0.33), Pilot Implementation Plan for the Reform of the System for Construction Project Approval in Shanghai (H.F.G. [2018] No.14), Regulations on Integrated Final Inspection of Construction Projects in Shanghai (H.Z.J.G.F.L. [2018] No.10) and other documents, in supporting the final inspection method to be changed to integrated final inspection, to achieve application via one-stop window, final inspection to be conducted in an integrated way and one-time issuance of certificate, after research, we decided to use Letter of Compliance for Integrated Final Inspection and Completion of Construction Project (hereinafter referred to as Letter of Compliance) in integrated final inspection after construction for new buildings and alteration and addition works for existing buildings. The relevant matters are hereby notified as follows:

I. Scope of application of Letter of Compliance

Letter of Compliance is applicable for all types of new buildings and alteration and addition works for existing buildings, and municipal infrastructure projects excluding transportation ones (hereinafter referred to as construction projects).

II. The Use and Format of Letter of Compliance

Letter of Compliance is issued by the construction administration departments after construction projects pass the integrated final inspection and based on the opinions of specialty inspection departments. Letter of Compliance is an electronic document, which can be downloaded and printed by enterprises themselves. Both electronic letter or hard copy are deemed as proof for the upcoming procedures of real estate registration (Please refer to the sample of Letter of Compliance in the Appendix). Enterprises will be notified to download the inspection documents issued by specialty inspection departments and Letter of Compliance, or the documents will be sent by email.

III. Process and Requirements of Issuance of Letter of Compliance

After construction projects complete the integrated final inspection (including conditional completion), construction administration departments should issue Letter of Compliance; for those complete with conditions, specialty inspection departments should supervise the owners to rectify within the specific time; for those fail to complete specialty inspection, Letter of Compliance will not be issued.

IV. Date of Starting the Use of Letter of Compliance

Letter of Compliance will be used for building projects starting from April 1, 2019. Letter of Compliance will be used for municipal infrastructure projects excluding transportation ones starting from October 1, 2019. Certificate of Filing of Completion and Final Inspection for Construction Project is canceled in Shanghai.
